Terms of sale

The sale of products on our website ("www.degageitalia.com") is governed by these General Conditions of Sale.



Products purchased on www.degageitalia.com are sold directly by Revealth srl, a company with registered office in Italy, at Via Bazzanese n. 32/7, 40033, Casalecchio di Reno (BO), Tax Code and VAT no. 03614851206, (hereinafter “Dégagé”).

1. Our trade policy

1.1

Dégagé carries out its e-commerce activities on the website www.degageitalia.com exclusively towards its end users who have reached the age of majority and who are "consumers".

1.2

When we talk about "consumer," we mean any natural person who is acting on www.degageitalia.com for purposes outside of their trade, business, or profession. If you are not a "consumer," we invite you to refrain from purchasing products on www.degageitalia.com and, if necessary, contact us directly at revealthsrl@gmail.com to discuss potential commercial agreements.

1.3

In accordance with its commercial policy, Dégagé reserves the right not to accept purchase order proposals from parties other than "consumers" or purchase order proposals that do not comply with its commercial policy, such as, for example, orders reported or suspected of fraudulent or illegal activity, or from parties with whom there are disputes and/or litigation. In such cases, Dégagé will notify the user of its non-acceptance of the order proposal.

1.4

These General Conditions of Sale govern exclusively the sending of purchase order proposals for products available or orderable on www.degageitalia.com by the user and their acceptance by Dégagé.

2. Information aimed at concluding the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70

2.1

To complete the purchase of one or more products on www.degageitalia.com, you must electronically submit a purchase order proposal to Dégagé by completing the form available on www.degageitalia.com and following the relevant instructions.

2.2

Before submitting your order proposal, we remind you to carefully read the General Terms and Conditions of Sale and the Right of Withdrawal Policy, to print a copy using the print button, and to save or reproduce a copy for your own personal use. In accordance with Article 51, paragraph 7, of Legislative Decree no. 206 of 6 September 2005 (the "Consumer Code"), before submitting your order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your purchase order proposal for the products and a summary of the essential characteristics of each product ordered, including the price (including all applicable taxes or duties), the payment methods you can use to purchase each product, the delivery methods for the purchased products, and the shipping and delivery costs. as well as Dégagé's contact information, address, and contact details, and the date by which Dégagé, once your order proposal has been accepted, undertakes to deliver the goods. Dégagé will also provide you with a summary of the terms and conditions for exercising your right of withdrawal. In any case, you will be reminded of the legal guarantee of conformity of the products, provided with the contact details of our after-sales service, and reminded of the option of using the alternative out-of-court dispute resolution platform, accessible at http://ec.europa.eu/odr , made available by the European Commission.

2.3

On the order confirmation page, which contains a link to the General Conditions of Sale and the Information on the Right of Withdrawal, we will provide you with summary information regarding the essential characteristics of each product indicated in your order proposal, the price (including all applicable taxes or duties) and the shipping costs.

2.4

Submitting an order proposal to Dégagé constitutes a binding purchase offer for the user. Before submitting the order proposal, you will therefore be asked to identify and correct any data entry errors.

2.5

Once you submit your order proposal, we will send you an automatic email to confirm receipt of your order proposal. Receipt of this email does not constitute acceptance of your order proposal.

2.6

The contract is concluded when your order proposal is accepted by Dégagé. Dégagé will send you a second email to confirm acceptance of your order proposal and shipment of the products. This email will also contain a copy of the General Terms and Conditions of Sale and the summary document on the Right of Withdrawal.

2.7

The order proposal sent to Dégagé will be archived in our database for the period of time necessary to process the order proposals accepted by the Seller and in any case within the terms of the law.

2.8

The language available for concluding the contract with Dégagé is Italian.

2.9

Dégagé may not accept your purchase order proposals if they do not provide sufficient guarantees of solvency or if they are incomplete or incorrect, or if the products are unavailable.

In these cases, Dégagé will inform you by email that the contract has not been concluded and that Dégagé has not accepted your purchase order proposal, specifying the reasons. If the products presented on www.degageitalia.com are no longer available or on sale at the time of receipt or processing of your purchase order proposal, Degage will inform you promptly and in any case within thirty (30) days from the day following the day on which you sent your order proposal to Dégagé of the possible unavailability of the products. If you have already paid the price for the products, Dégagé will refund, without undue delay, the amount already paid by you and the sales contract will be considered terminated, excluding any claim on your part for damages, indemnity or otherwise.

Dégagé also reserves the right not to accept purchase order proposals in the cases referred to in the previous paragraph 1.3.

2.10

We remind you that by electronically submitting your order proposal, you unconditionally accept and agree to abide by Dégagé's General Terms and Conditions of Sale. If you do not agree with any of the terms set forth in the General Terms and Conditions of Sale, we invite you not to submit your order proposal for the purchase of products on www.degageitalia.com.

2.11

By submitting your order proposal, you confirm that you are aware of and accept the additional information contained on www.degageitalia.com, including those accessed via links, including the General Conditions of Sale, the Privacy Policy, and the Information on the Right of Withdrawal.

3. Products, Guarantees and indication of product prices

3.1

Dégagé sells exclusively products made directly, using skilled labor and personally selecting high-quality fabrics and accessories (such as buttons, trimmings, lace and more).

3.2

The main product characteristics are presented on www.degageitalia.com within each product page. The images and colors of the products presented on www.degageitalia.com may, however, differ from the actual colors due to the Internet browser and monitor used.

3.3

If you would like to create one of Dégagé's products in a different color, pattern, or design than those available on www.degageitalia.com, or in a size not currently available, please contact Dégagé at revealthsrl@gmail.com . Dégagé will be happy to create a custom product for you and, to this end, can email you images of other available colors, patterns, or designs, along with the product price (including all applicable taxes and duties) and shipping costs. This email will also include a link to the General Terms and Conditions of Sale and the Returns Policy.

If you like one of the options, you can place your order by email, specifying the product model name, size, color/pattern code, and shipping address. This email to Dégagé constitutes an order confirmation and constitutes a binding offer to purchase. Dégagé cannot be held responsible for any errors in the information.

Dégagé will then send you a further email summarizing your order and containing the IBAN code to which you can make the payment via bank transfer, as well as, once again, links to the General Terms and Conditions of Sale and the Information on the Right of Withdrawal.

Once the payment has been received in Dégagé's bank account, the sales contract will be considered concluded and you will no longer be able to cancel and/or modify the order. Dégagé undertakes to manufacture and deliver the product you purchased to the courier within 20 (twenty) working days of receiving the payment. Dégagé will inform you by email once the product has been handed over to the courier for delivery.

If Dégagé does not deliver the product to the courier within the timeframe indicated above, you will be free to cancel your order by sending an email to the following address www.degageitalia.com . In this case, Dégagé will refund the amount paid by bank transfer to the same account from which your payment was received, according to the conditions set forth in Article 8 below. If you do not notify us of cancellation and once you have received the email from Dégagé notifying you that the product has been delivered to the courier, you will no longer be able to cancel your order.

All these General Conditions of Sale, insofar as they are compatible, as well as the Information on the Right of Withdrawal, also apply to orders for ad hoc products such as those governed by this Article 3.3.

3.4

Product prices may be subject to change. Please check the final price before submitting your order. If Dégagé detects a recognizable error in the price indicated by Dégagé or in the calculation of the requested payment amount, Dégagé will not accept the order and will contact you to offer you the opportunity to submit your purchase order for the product(s) at the correct price.

3.5

Purchase requests from countries not included in the following cannot be accepted by Dégagé: Europe.

If you are outside Europe but still want a Dégagé product, please contact us at revealthsrl@gmail.com. We will be happy to arrange a custom shipping option for you. In this case, the provisions of Article 3.3 above will apply, where applicable. In this case, any customs duties will also be your responsibility.

3.6

All products sold on www.degageitalia.com are covered by a twenty-four (24) month legal guarantee for defects of conformity, in accordance with applicable law. Any defects of conformity of products sold by Dégagé may be reported to Dégagé by sending an email to revealthsrl@gmail.com or by registered mail. Dégagé will inform you of the procedures for returning the product(s).

Upon receipt, Dégagé reserves the right to inspect returned products that are defective or non-compliant with your order. In the event of a defect, you have the right to request repair or replacement of the product. If the aforementioned remedies are not possible or are excessively costly, you will be entitled to a price reduction or termination of the sales contract, pursuant to Article 135 bis of the Consumer Code.

If Dégagé finds no defects or non-conformity in the returned products, you will be informed that your return cannot be accepted and you will have the option of having the purchased products returned. If you refuse the shipment, Dégagé will have the right to retain the products and the purchase price of the products, and reserves the right to claim any costs incurred.

4. Payments

4.1

To pay for the products and related shipping and delivery costs, you can use one of the methods indicated in the order proposal form. Under no circumstances will you be charged costs greater than those actually incurred by Dégagé, based on your chosen payment method.

4.2

If you pay by credit card, your financial information (for example, your credit/debit card number or expiration date) will be forwarded to the bank providing the relevant remote electronic payment service via encrypted protocol, without any third party access. Furthermore, this information will never be used by Dégagé except to complete the procedures relating to your purchase and to issue refunds in the event of product returns, following the exercise of your right of withdrawal, or when necessary to prevent or report fraud on the website www.degageitalia.com to the police. The price for the purchase of the products and shipping costs, as indicated in the order proposal, will be charged to your current account upon shipment of the purchased products.

5. Shipping and delivery of products

5.1

Shipping will be via GLS courier, with costs of €15.00 for Italy and €25.00 for other European countries, paid by the Consumer for orders less than or equal to €400.00. Shipping costs above this amount are paid by Dégagé.

5.2

Once Dégagé receives the order acceptance email referred to in Article 2.6 above, it undertakes to prepare and deliver the order to the courier within 3 working days. The courier will then deliver the order within a further 3 working days in Italy and within 5 working days in other European countries. Any delays in delivery by the courier cannot be attributed to Dégagé in any way, and no claims for damages, compensation, or otherwise may be made.

6. Customer support

6.1

7. Right of withdrawal

7.1 You can consult the Right of Withdrawal Information in the dedicated section. It is an integral part of these General Terms and Conditions of Sale.

8. Refund times and methods

8.1

Whatever the payment method you used, the refund due, whether full or partial, is activated by Dégagé, as quickly as possible and in any case within fourteen (14) days from the date on which Dégagé became aware of the exercise of your right of withdrawal, after verifying the correct execution of your right of withdrawal and checking the returned products.

8.2

Dégagé will refund you using the same payment method you used to purchase the returned products, unless you have expressly agreed with Dégagé to use a different payment method and provided that you do not incur any additional costs as a result of the refund. If the recipient of the products indicated in the order proposal is not the same as the person who made the payment for the products, in the event that you exercise your right of withdrawal, Dégagé will refund the amount to the person who made the payment.
