Information on the Right of Withdrawal
A - General
Pursuant to Article 52 of Legislative Decree No. 206 of 6 September 2005 (the "Consumer Code"), you have the right to withdraw from the contract signed with Dégagé without penalty and without having to provide any reason, within 14 (fourteen) days from the day you received the products purchased on www.degageitalia.com.
In accordance with art. 54 of the Consumer Code, you may exercise the right of withdrawal using, at your choice, one of the
following methods:
Return form to be sent via the website www.degageitalia.com;
send the Return Form to Dégagé by post, which must be completed in full;
sending by post to Dégagé another explicit declaration of your decision to withdraw from the contract.
In cases b) and c), your declaration must be sent to the registered office of Revealth srl, located at Via Bazzanese 32/7 40033 Casalecchio di Reno (Bologna). It is understood that, in these cases, you will be responsible for proving the correct and timely exercise of the right of withdrawal.
In accordance with art. 57 of the Consumer Code, once you have exercised your right of withdrawal from the contract, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to Dégagé your decision to withdraw from the contract.
Dégagé does not allow product exchanges.
Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded if you have purchased custom-made or personalized products or sealed goods that are not suitable for return due to hygiene or health protection reasons and were opened after delivery.
B - Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer Code
The right of withdrawal is considered to have been correctly exercised if the following conditions are fully met:
a. the right of withdrawal must be regularly exercised within 14 (fourteen) days of receiving the products following one of the methods indicated above;
b. the products must not have been used, worn, or washed and, in any case, must comply with the requirements indicated in point D below on the conformity checks of returned products;
c. the identification tag must still be attached to the products and forms an integral part of the item;
d. the products must be returned in their original packaging;
e. the returned products must be delivered to the carrier within fourteen (14) days from when you communicated to Dégagé your decision to withdraw from the contract;
f. the products must not be damaged.
If you have complied with all the required conditions, Dégagé, in accordance with Article 56 of the Consumer Code, will refund you the full price of the purchased products. You will only be responsible for the return costs, i.e., those for returning the purchased products to Dégagé, unless you use the shipping method and shipping method recommended by Dégagé in Section C below.
C - How to return products to Dégagé
Dégagé recommends using GLS to return purchased products. If you choose GLS for shipping, you will not have to pay the return shipping costs yourself. Dégagé will pay the courier on your behalf, deducting from your refund a flat fee equal to the cost previously incurred for home delivery of the purchased products.
Contact GLS to arrange collection and package the product(s) you wish to return (you can use the same box/packaging in which you received them). The courier will provide you with the label with the destination address.
This shipping method also allows you to check the location of each package at any time, freeing you from any liability in the event of loss or damage to products during transport.
If you choose a courier other than GLS, you will be responsible for the return shipping costs and will be liable for any loss or damage to the products during transport. You must address the shipment to:

It is understood that, in this case, an amount equivalent to the standard shipping cost of the purchased products will also be refunded. However, pursuant to Article 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for choosing a different and/or faster shipping and delivery method than the standard one will not be refunded.
D - Compliance checks of returned products
You will be contacted if your return cannot be accepted because it does not comply with the conditions set out in letters a) and e) of point B above, or in the case referred to in Article 59 of the Consumer Code, and you may choose to have the purchased products returned to you at your own expense. If you refuse this shipment, Dégagé reserves the right to retain the products and the purchase price.
All products must be returned in new and unused condition, with all protective materials and tags and stickers still attached (if applicable), along with their packaging, accessories, and documentation. If the product shows signs of use or has been used or altered from its original condition in any way, Dégagé reserves the right to refuse the return or, alternatively, reduce the refund or exchange amount accordingly.
For example, Dégagé may reduce the refund in the following circumstances:
• the products have been used, worn, damaged or washed;
• the identification tag is no longer attached to the products or has not been returned. Please note that the identification tag is an integral part of each product; and/or
• the original packaging which is an integral part of the product (e.g. the protective bag) has not been returned;
You will be contacted if Dégagé decides to reduce your refund for this reason. In this case, you may choose (as an alternative to reducing your refund) to have the purchased products returned to you at your own expense. In the latter case, if you refuse the shipment, Dégagé will have the right to retain the products and the amount indicated for the reduction in the refund due to the decreased value of the returned products.
Dégagé assumes no responsibility for products returned in error or for items forgotten in packages or returned products.
E - Refund times and methods
Once Dégagé has received your return and checked that all the requirements have been met, you will receive an email confirming acceptance of the return and Dégagé will proceed with the full refund, or, if a decrease in value of the returned products is found, you will receive an email informing you of the amount deducted from the refund and Dégagé will proceed with the refund of the amount due. Whichever payment method you used among those available, the refund will be activated by Dégagé as soon as possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of your right of withdrawal, once it has verified that the withdrawal has taken place in compliance with the conditions set out above.
The actual time for the refund or reimbursement of the sums you paid for the purchase of the products depends on the payment methods used:
• purchase by credit/debit card: the refund time depends on the credit/debit card company, but normally occurs within two bank statements;
• Purchase via PayPal (if available): The refund will be credited to your PayPal account and will be visible immediately. The actual refund to your credit card from your PayPal account depends on the card issuer.
In the case of a gift, the refund will be made to the person who made the payment.

The conditions for exercising the right of withdrawal set forth in this Policy, which form an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.
